THE FOLLOWING DESCRIBES THE TERMS UNDER WHICH YOU MAY ACCESS AND USE SAVANNA ENERGY’S WEBSITE LOCATED AT WWW.SAVANNAENERGY.COM.  BY ACCESSING OR USING ANY OF THE WEBSITE YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT.  IF YOU DO NOT AGREE WITH THE TERMS SET OUT IN THIS AGREEMENT YOU MAY NOT ACCESS OR USE THE WEBSITE.

Amendments

Savanna Energy Services Corp. and its affiliated companies (collectively, “Savanna”) may amend this website terms of use agreement (the “Agreement”) at any time by posting a new agreement in place of this one.  The amended agreement shall automatically be effective when posted.  Notice of the amendment will be posted on the main page of the Website for a period of thirty (30) days following such posting.  Your continued use of the website located at savannaenergy.cornerstonedigital.ca (the “Website”) following the posting of the amended Agreement and the posting of such notice shall mean that you accept the terms of this Agreement as amended.  The first paragraph of this Agreement indicates when this Agreement was last amended.  Please check back regularly to review for changes.

Limited License and Restrictions

Conditional on your agreement to this Agreement, Savanna grants to you a limited, non-exclusive, revocable, non-assignable and personal license to access, view and print (for your viewing only) the content on the Website (the “Content”) for your own personal and non-commercial use.  You may not otherwise access, view or print the Content and you may not modify, reproduce, download, publish, disseminate, transmit, sell, create derivative works, display, frame or in any way exploit any of the Content, except with the express written permission of Savanna.

Savanna may change, add to or delete from the Website, the Content or any related services at any time without notice.  You agree to bear all risks, costs and damages that you may incur or suffer as a result of those changes.

No Agency

No Waiver

Savanna’s failure to insist upon or enforce strict compliance with any provision of this Agreement shall not be construed as a waiver of any provision or right of the same or different type in the future.

Entire Agreement

The terms and conditions set out in this Agreement constitute the entire terms and conditions with respect to the use of the Website, Content and any related services and the relationship between the parties for the purposes of the same.  No representative of Savanna is authorized to amend the terms of this Agreement other than as specifically provided for herein.

Termination

Notwithstanding the termination or expiration of this Agreement for any reason, in addition to the provisions of this Agreement that would by their nature survive such termination or expiration, the provisions relating to intellectual property, warranty disclaimer, limited liability and governing law shall survive such termination or expiration.

Governing Law

This Agreement, the relationship between you and Savanna and your use of the Website, the Content and any related services and the resolution of any dispute arising between the parties shall be governed and construed in accordance with the laws of the Province of Alberta and those of Canada applicable therein, without reference to their conflict of laws.  You agree that any legal action or proceeding between you and Savanna which in any way concerns this Agreement or the use of the Website or Content shall be brought exclusively in the courts of Alberta.  Notwithstanding the foregoing, either party may apply to any court of competent jurisdictions to obtain injunctive relief.  Savanna is headquartered in Alberta, Canada.

Severability

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be severed from this Agreement and the remaining provisions shall remain in full force and effect.

Headings are for reference purposes only and shall not be used in the interpretation of this Agreement.
